Why won't Google Penalize sites that have duplicate content

Hi SEOGroup1

A competitor's site that was started in Oct 08 has really good
listings for competitive phrases. I looked them up on Copyscape.com
because their layout/content was gimmicky looking. Copyscape showed
duplicate or very closely matching content to many other sites. Why
would Google let them climb so high so fast without penalty? Is it
because each one has a different city target (i.e. Orlando boot camp,
Chicago boot camp)? The rest of the content is very close in matching.
But showing up #2 for Orlando boot camp in less than 7 months makes me
think that Google isn't punishing for duplicate content or the names
of the cities is just enough to keep it from being seen as duplicate.

The site is notyouraveragebootcamp.com
